The Service is designed to assist real estate developers, investors, planners, and land use professionals in researching municipal zoning codes, understanding entitlement requirements, and identifying development potential for specific parcels.

2. AI Output Disclaimer

RealClear AI output is generated by artificial intelligence and is provided for informational and research purposes only. It is not legal advice, not a substitute for professional land use counsel, and may contain errors, omissions, or inaccuracies.

Zoning codes, land use regulations, and entitlement requirements vary significantly by jurisdiction and change frequently. AI-generated analysis may not reflect the most current regulations, may misinterpret complex or ambiguous code provisions, and may fail to account for overlay districts, specific plan areas, development agreements, or other site-specific conditions.

You should independently verify all information before making any investment, development, or legal decisions. In no event shall RealClear be liable for any damages arising from reliance on AI-generated output.

Nothing in the Service or any output generated by it constitutes legal advice or creates an attorney-client relationship. You should consult a qualified land use attorney, planner, or other licensed professional for advice specific to your situation.

3. User Responsibilities

By using the Service, you agree to:

Independently verify AI-generated output before relying on it for any purpose.
Not use AI output as the sole basis for investment, development, permitting, or legal decisions.

Use the Service only for lawful purposes and in compliance with all applicable laws and regulations.
Not attempt to reverse-engineer, scrape, or extract data from the Service in unauthorized ways.
Keep your account credentials secure and notify us promptly of any unauthorized access.

4. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, REALCLEAR’S AGGREGATE LIABILITY TO YOU FOR ANY CLAIMS ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICE SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID REALCLEAR IN THE TWELVE MONTHS PRECEDING THE CLAIM, OR (B) ONE HUNDRED DOLLARS ($100).

IN NO EVENT SHALL REALCLEAR BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, LOSS OF DATA, LOSS OF GOODWILL, OR BUSINESS INTERRUPTION, EVEN IF REALCLEAR HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OR LIMITATION OF INCIDENTAL OR CONSEQUENTIAL DAMAGES, SO THE ABOVE LIMITATIONS MAY NOT APPLY TO YOU.

5. Intellectual Property

The Service, including all software, designs, text, graphics, and other content created by RealClear, is owned by RealClear and protected by copyright, trademark, and other intellectual property laws. You are granted a limited, non-exclusive, non-transferable license to access and use the Service for your internal business purposes in accordance with these Terms.

You retain ownership of any data, documents, or materials you upload to the Service. By uploading content, you grant RealClear a limited license to process that content solely to provide the Service to you.

6. Termination

Either party may terminate these Terms at any time. RealClear may suspend or terminate your access to the Service immediately, with or without notice, if you breach these Terms or engage in conduct that RealClear determines, in its sole discretion, is harmful to the Service, other users, or third parties. Upon termination, your right to use the Service will immediately cease.

7. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the State of California, without regard to its conflict of law provisions. Any dispute arising out of or relating to these Terms or the Service shall be subject to the exclusive jurisdiction of the state and federal courts located in San Francisco County, California. You consent to personal jurisdiction in such courts.

8. Changes to These Terms

We may modify these Terms from time to time. If we make material changes, we will notify you by email or through the Service at least 14 days before the changes take effect. Your continued use of the Service after the effective date of revised Terms constitutes your acceptance of the changes.
